  • f you have purchased your Anna Campbell dress or accessory at one of our Australian or international retailers, please contact that retailer directly for information about returns, exchanges or what to do if you aren't happy with the quality of your Anna Campbell item.

    The information below is for brides who have purchased their Anna Campbell accessories via our online boutique. If you have purchased a wedding dress direct from our Brunswick studio, our Online Stylist will provide you with all the information you need to know before you place your order!

    ACCESSORIES (EXCLUDING EARRINGS)

    For online orders you may exchange or return your Anna Campbell accessories (excluding toppers and earrings) within 7 days of receipt, after contacting us at hello@annacampbell.com.au. Please ensure your unworn item is carefully packaged in its original packaging (as Anna Campbell cannot accept responsibility for accessories damaged in transit).

    Please remember that, for changes of mind, you will be responsible for the postage and customs charges (if applicable) on both the return and replacement item(s). Please allow 7 business days for the processing and shipment of your exchange.

    If you believe that your accessory is faulty, or is not correct to your order, please follow the procedure outlined below.

    EARRINGS

    For hygiene reasons, we cannot offer any exchange or return on earrings for change of mind.

    Anna Campbell earrings are made from sterling silver and are nickel free. Anna Campbell earrings are delicate and should be stored safely in your Anna Campbell jewellery case, away from perfume, moisturiser or hairsprays. Damage from careless wear or storage is not the responsibility of Anna Campbell.

    All Anna Campbell earrings come with a 6-month warranty from the date of purchase. This warranty covers manufacturing faults, but will not cover damage caused by careless handling or general wear and tear. We will replace or repair your damaged earrings at our discretion. If you need to make a warranty claim, please contact our Online Orders Manager at hello@annacampbell.com.au.

    DRESSES AND BRIDAL SEPARATES

    Our Dresses and Bridal Separates are made to order for each one of our brides, and we begin creating your pieces as soon as your order is placed. Due to the handmade and hand-embellished nature of our Dresses, Toppers, and Separate Skirts, we cannot accept any returns, refunds, or exchanges for online orders purchased through the shop or with our Online Stylist. We do recommend brides take careful consideration when purchasing, so please work with our Online Stylist to choose your sizing and styling with confidence!

    HAVE YOU FOUND A FAULT?

    Anna Campbell carefully quality controls each and every accessory and dress at our Brunswick studio before it is shipped to you.

    For online orders, Anna Campbell will happily accept the return of toppers and accessories for replacement or repair in the unlikely case of minor faults, or if the item is not correct to the size, style, and colour chosen by you at the time of ordering.

    A refund will only be offered in cases of major faults, the existence of which will be determined at the discretion of our Quality Control Manager, after a thorough assessment of your item.

    If you believe that your topper or accessory contains a fault, or is not what you ordered:

    • Please contact us at hello@annacampbell.com.au with your invoice number, photos and a detailed explanation of the fault or issue within 7 days of receiving the item.

    • If we cannot resolve your concern via email or telephone, we may require you to return the topper or accessory to us so our Quality Control Manager can carefully assess the item upon return.

    • To be eligible for a replacement, repair or refund, all items must be postmarked returned to our Brunswick studio within 14 days of receipt.

    • Anna Campbell toppers and accessories are handmade, the embellishments are hand beaded and the fabrics are 100% natural silk. For this reason, natural flaws in the silk and slight abnormalities in the laces, embellishments (including one or two beads loose or missing), or a slight inconsistency in the weave or colour of the fabrics will not be considered faulty by Anna Campbell. These variations are consistent with the individuality of hand-made silk gowns, and in fact make your dress 100% unique to you!

    • If we have made a mistake, or the item is assessed as faulty by our Quality Control Manager, we will replace or repair your item and reimburse your return freight charges in AUD (only if a receipt is enclosed). Postage for your replacement item will not be charged.

    • As we make our accessories and toppers available to brides all around the world, Anna Campbell cannot refund international duties and taxes. For information about these charges, we recommend contacting your local customs office.

    • If, after inspection, the dress passes our quality control checks, you will not be offered any replacement, repair or refund and we will return the dress or accessory to you at your expense (including additional shipping and customs charges, if applicable).

    A few things to remember…

    • To be eligible for an exchange or return, replacement or repair, all items must be returned in their original condition and must not have been worn, altered or washed.

    • All tags must remain in place and the items must be returned in their original packaging.

    • Anna Campbell reserves the right to refuse a repair, replacement or refund if you do not notify us of the fault or issue within 7 days of receipt, and/or do not return the item upon request to our Brunswick studio within 14 days. This does not affect any statutory rights that may arise.

    • Anna Campbell cannot accept liability for the loss or damage of the returned goods during shipping.

  • Anna Campbell charges in Australian Dollars (AUD) and all prices quoted on this website do not include shipping or any applicable international customs charges.

    We are thrilled to be able to offer free shipping to our Australian brides on all accessories orders over $500!

    International orders will incur a charge dependent on the item being ordered.

    Once your order has been shipped you will be sent a shipment confirmation email with your tracking details.

    Please be aware that orders are not shipped over weekends or public holidays in the State of Victoria, Australia.

    WITHIN AUSTRALIA

    All items ordered within Australia are sent with Australia Post or DHL and should be in your loving arms within 7-10 business days. Please remember that this is an estimation only and may not take into consideration weekends, public holidays and unforeseen transit delays. Delivery to regional Australia via Australia Post may take longer. Once your order has been shipped you will be sent a shipment confirmation email with your tracking details. All orders require a signature on delivery. If your Anna Campbell order doesn’t arrive within 10 business days of shipment, please email hello@annacampbell.com.au to let us know.

    INTERNATIONAL

    If you are an international bride, we will ship your order DHL Express, meaning your sparkling accessories should arrive within 14-21 days. Once your order has been shipped you will be sent a shipment confirmation email with your tracking details. All orders require a signature on delivery. If your parcel has not arrived within 28 business days of dispatch, please email hello@annacampbell.com.au to let us know. 

    Please note that we have recently had difficulties shipping orders to Russia & China. If you are placing an order from either of these two countries, please contact our Online Stylist for further information prior to placing your order via our Online Boutique.

    CUSTOMS, TAXES AND IMPORT CHARGES

    We play by the rules. Every time we ship items overseas, we are required by law to declare the full amount of the invoice and the entire contents of the parcel on the customs declaration form and the accompanying invoice.

    If your country requires import tax to be paid our shipping provider, DHL, or your country’s customs office will contact you to advise you of the required payment. Your order may be held at customs until this import tax is paid.

    Anna Campbell is not responsible for the payment of customs tax, and Anna Campbell cannot accept returns due to high import taxes being charged. If you are concerned about what customs taxes and duties may be payable on your order, we strongly recommend contacting your local customs office for further information prior to placing your order. We are not able to provide any advice as to what import tax may be applicable in your country.

    POSTAGE DELAYS

    All delivery times are provided as estimates only. Anna Campbell is not responsible for any delays caused or incurred by delivery services or international customs clearance processes.

    We at Anna Campbell are providing this Privacy Policy to explain our practices regarding the collection, use and disclosure of information that we receive through our Services. This Privacy Policy is incorporated by reference into the Anna Campbell Terms of Service (“the Terms”). The terms “Anna Campbell,” “we,” and “us” include Anna Campbell Pty Ltd.

    This Privacy Policy explains our online and offline information practices, the kinds of information we may collect, how we intend to use and share that information, and how you can opt out of a use or correct or change such information. Also, please note that, unless we define a term in this Privacy Policy, all capitalised terms used in this Privacy Policy have the same meanings as in our Terms of Service. So, please make sure that you have read and understand our Terms of Service.

    SCOPE

    This Privacy Policy applies to Personal Information that is Processed by Anna Campbell in the course of our business, including on Anna Campbell websites (each a “Site”), mobile applications, forums, blogs, and other online or offline offerings (together with any and all future online and offline offerings operated by or on behalf of Anna Campbell, the “Services”). This Privacy Policy does not apply to any third-party websites, services or applications, even if they are accessible through our Services. All individuals whose responsibilities include the Processing of Personal Information on behalf of Anna Campbell are expected to protect that data by adherence to this Privacy Policy. This Privacy Policy is intended to meet requirements globally, including those in North America, Europe, APAC, and other jurisdictions.

    TRANSPARENCY/NOTICE – Types of Personal Information We Collect and How We Use It

    Our primary goals in collecting information are to provide and improve our Services, to administer your use of the Services (including your Account, if you are an Account holder), and to enable you to enjoy and easily navigate our Services. The types of Personal Information we may collect (directly from you or from Third-Party sources) and our privacy practices depend on the nature of the relationship you have with Anna Campbell and the requirements of applicable law. Some of the ways that Anna Campbell may collect Personal Information include:

    o   You may provide Personal Information directly to Anna Campbell through interacting with the Services, making online or in-store purchases, participating in surveys, during events such as sweepstakes, and requesting Services or information.

    o   As you navigate the Services, certain passive information may also be collected about your visit, including through cookies and similar technologies as described below.

    We endeavour to collect only that information which is relevant for the purposes of Processing. Below are the ways we collect Personal Information and how we use it.

    Types of Personal Information We Collect

    Anna Campbell collects Personal Information regarding its current, prospective, and former clients, customers, users, visitors, guests, and Employees. (collectively “Individuals”).

    o   Information You Provide Directly to Us. When you use the Services or engage in certain activities, such as registering for an Account with Anna Campbell, making an online or in-store purchase, responding to surveys, requesting Services or information, or contacting us directly, we may ask you to provide some or all of the following types of information:

    o   Creating an Account with Us. When you make a purchase online or in an Anna Campbell store, we will automatically create an Account for you. To create an Account, we’ll collect certain information that can be used to identify you, such as your name, postal address and phone number, as well as other optional information you may provide like the type of clothing you prefer. If you create an Account using your login credentials from one of your third-party services accounts such as Facebook or Google (each an “Third-Party Account”), we’ll be able to access and collect your name and email address and other Personal Information that your privacy settings on the Third-Party Account permit us to access. If you create an Account through the Site or one of your Social Networking Services (“SNS”) Accounts, we may also collect your gender or date of birth.

    o   Communications with Us. We may collect Personal Information from you such as email address, phone number or mailing address when you choose to request information about our Services, create an account, register for Anna Campbell’s newsletter or a loyalty program that we may offer from time to time, request to receive customer or technical support, or otherwise communicate with us.

    o   Surveys. From time to time, we may contact you to participate in online surveys. If you do decide to participate, you may be asked to provide certain information which may include Personal Information. All information collected from your participation in our surveys is provided by you voluntarily. We may use such information to improve our products, Sites and/or services and in any manner consistent with the policies provided herein.

    o   Registration for Sweepstakes or Contests. Occasionally, Anna Campbell may run sweepstakes and contests. We ask those who enter in the sweepstakes or contests to provide contact information (e.g., an e-mail address). If you participate in a sweepstakes or contest, your contact information may be used to reach you about the sweepstakes or contest, and for other promotional, marketing and business purposes. All sweepstakes/contests entry forms will provide a way for participants to opt-out of any communications that are not related to awarding prizes.

    o   Automatic Data Collection. Our servers automatically record certain information about how Individuals use our Services (we refer to this information as “Event Data”). Event Data may include information such as an Individual’s Internet Protocol (IP) address, cookie identifiers, MAC address, IMEI, Advertiser ID, and other device identifiers that are automatically assigned to your computer or device when you access the Internet, operating system, browser type and language, hardware type, the web page that a User was visiting before accessing our Services, the pages or features of our Services to which a User browsed and the time spent on those pages or features, search terms, the links on our Services that a User clicked on and other statistics. We use Event Data to administer the Services and we analyze (and may engage third parties to analyze) Event Data to improve, customize and enhance our Services by expanding their features and functionality and tailoring them to Individuals’ needs and preferences. We may use a person’s IP address to generate aggregate, non-identifying information about how our Services are used.

    o   Location Information. We may collect and store information about your location by converting your IP address into a rough geo-location. We may use location information to improve and personalize our Services for you. If you do not want us to collect location information, you may disable that feature on your mobile device.

    o   Information Submitted Via Services. You agree that Anna Campbell is free to use the content of any communications submitted by you via the Services, including any ideas, inventions, concepts, techniques, or know-how disclosed therein, for any purpose including developing, manufacturing, and/or marketing goods or Services. Anna Campbell will not release your name or otherwise publicize the fact that you submitted materials or other information to us unless: (a) you grant us permission to do so; (b) we first send notice to you that the materials or other information you submit to a particular part of a Service will be published or otherwise used with your name on it; or (c) we are required to do so by law.

    o   Information from Other Sources. We may receive information about you from other sources, including through Third-Party services and organizations to supplement information provided by you. For example, if you access our Services through a Third-Party application, such as an App Store or SNS, we may collect information about you from that Third-Party application that you have made public via your privacy settings. Information we collect through App Stores or SNS accounts may include your name, your SNS user identification number, your SNS user name, location, sex, birth date, email, profile picture, and your contacts on the SNS. This supplemental information allows us to verify information that you have provided to Anna Campbell and to enhance our ability to provide you with information about our business, products, and Services.

    How Anna Campbell Uses Your Information

    We acquire, hold, use, and Process Personal Information about Individuals for a variety of business purposes, including:

    o   To Provide Products, Services, or Information Requested. Anna Campbell may use information about you to fulfill requests for products, Services, or information, including information about potential or future Services, including to:

    o   Generally manage Individual information and Accounts;

    o   Respond to questions, comments, and other requests;

    o   Provide access to certain areas, functionalities, and features of Anna Campbell’s Services;

    o   Contact you to answer requests for customer support or technical support;

    o   Allow you to register for events.

    o   Administrative Purposes. Anna Campbell may use Personal Information about you for its administrative purposes, including to:

    o   Measure interest in Anna Campbell’s products and Services;

    o   Prevent potentially prohibited or illegal activities;

    o   Enforce our Terms.

    o   Marketing Anna Campbell Products and Services. Anna Campbell may use Personal Information to provide you with materials about offers, products, and Services that may be of interest, including new content or Services. Anna Campbell may provide you with these materials by phone, postal mail, facsimile, or email, as permitted by applicable law. Such uses include:

    o   To tailor content, advertisements, and offers;

    o   To notify you about offers, products, and services that may be of interest to you;

    o   To provide Services to you and our sponsors;

    o   For other purposes disclosed at the time that Individuals provide Personal Information; or

    o   Otherwise with your consent.

    You may contact us at any time to opt out of the use of your Personal Information for marketing purposes, as further described below.

    o   Research and Development. We may share aggregated information and non-identifying information with third parties for industry research and analysis, demographic profiling and other similar purposes. We may contract with third parties who provide us with other information about you, which we may then combine with the information we receive from you. We use this information to better provide our Services, to customize our advertisements to you and other customers, and to provide direct marketing to you, including by mail.

    From time to time, Anna Campbell may perform research (online and offline) via surveys. We may engage Third-Party service providers to conduct such surveys on our behalf. All survey responses are voluntary, and the information collected will be used for research and reporting purposes to help us better serve Individuals by learning more about their needs and the quality of the products and services we provide. The survey responses may be utilized to determine the effectiveness of our Services, various types of communications, advertising campaigns, and/or promotional activities. If an Individual participates in a survey, the information given will be used along with that of other study participants. We may share anonymous Individual and aggregate data for research and analysis purposes.

    o   Direct Mail, Email and Outbound Telemarketing. Individuals who provide us with Personal Information, or whose Personal Information we obtain from Third Parties, may receive periodic emails, newsletters, mailings, or phone calls from us with information on Anna Campbell’s or our business partners’ products and services or upcoming special offers/events we believe may be of interest. We offer the option to decline these communications at no cost to the Individual by following the instructions in Section 6 below.

    o   Anonymous and Aggregated Information Use. Anna Campbell may use Personal Information and other information about you to create anonymized and aggregated information, such as de-identified demographic information, de-identified location information, information about the computer or device from which you access Anna Campbell’s Services, or other analyses we create. Anonymized and aggregated information is used for a variety of functions, including the measurement of visitors’ interest in and use of various portions or features of the Services. Anonymized or aggregated information is not Personal Information, and Anna Campbell may use such information in a number of ways, including research, internal analysis, analytics, and any other legally permissible purposes. We may share this information within Anna Campbell and with Third Parties for our or their purposes in an anonymized or aggregated form that is designed to prevent anyone from identifying you.

    o   Sharing Content with Friends or Colleagues. Anna Campbell’s Services may offer various tools and functionalities. For example, Anna Campbell allows you to provide information about your friends through our referral services, such as “Invite a Friend.” Our referral services may allow you to forward or share certain content with a friend or colleague, such as an email inviting your friend to use our Services. Email addresses that you may provide for a friend or colleague will be used to send your friend or colleague the content or link you request, but will not be collected or otherwise used by Anna Campbell or any other Third Parties for any other purpose.

    o   Other Uses. Anna Campbell may use Personal Information for which we have a legitimate interest, such as direct marketing, individual or market research, anti-fraud protection, or any other purpose disclosed to you at the time you provide Personal Information or with your consent.

    Cookies, Pixel Tags/Web Beacons, Analytics Information, and Interest-Based Advertising

    We, as well as Third Parties that provide content, advertising, or other functionality on our Services, may use cookies, pixel tags, local storage, and other technologies (“Technologies”) to automatically collect information through the Services. We use Technologies that are essentially small data files placed on your computer, tablet, mobile phone, or other devices (referred to collectively as a "device") that allow us to record certain pieces of information whenever you visit or interact with our sites, services, applications, messaging, and tools, and to recognise you across devices.

    o   Social Media Widgets: Our Website includes social media features such as the Facebook “Like” button and LinkedIn (that might include widgets such as the share this button or other interactive mini-programs). These features may collect your IP address, which page you are visiting on our site, and may set a cookie to enable the feature to function properly. These social media features are either hosted by a Third Party or hosted directly on our Website. Your interactions with these features are governed by the privacy policy of the company providing it.

    o   Analytics. We use Google Analytics, a service provided by Google, Inc. (“Google”), to gather information about how users engage with our Services. We may use cookies, web beacons, or other similar technologies that allow us to offer you enhanced functionality when accessing or using our sites, services, applications, or tools. This may include identifying you when you sign into our sites or keeping track of your specified preferences, interests, or past items viewed so that we may enhance the presentation of content on our sites;

We may use first-party or third-party cookies and web beacons to deliver content, including ads relevant to your interests, on our sites or on third party sites. This includes using technologies to understand the usefulness to you of the advertisements and content that has been delivered to you, such as whether you have clicked on an advertisement.
    If you would like to opt out of the Technologies we employ on our sites, services, applications, or tools, you may do so by blocking, deleting, or disabling them as your browser or device permits.

     

    Third-party websites, Social Media platforms, and Software Development Kits

    The Site may contain links to other websites and other websites may reference or link to our Site or other Services. These other domains and websites are not controlled by us, and Anna Campbell does not endorse or make any representations about Third-Party websites or social media platforms. We encourage our users to read the privacy policies of each and every website and application with which they interact. We do not endorse, screen or approve, and are not responsible for the privacy practices or content of such other websites or applications. Visiting these other websites or applications is at your own risk.

    Anna Campbell’s Services may include publicly accessible blogs, community forums, or private messaging features. The Site and our other Services may also contain links and interactive features with various social media platforms (e.g., widgets). If you already use these platforms, their cookies may be set on your device when using our Site or other Services. You should be aware that Personal Information which you voluntarily include and transmit online in a publicly accessible blog, chat room, social media platform or otherwise online, or that you share in an open forum may be viewed and used by others without any restrictions. We are unable to control such uses of your information when interacting with a social media platform, and by using such services you assume the risk that the Personal Information provided by you may be viewed and used by third parties for any number of purposes.

    Third-Party Payment Processing

    When you make purchases through the Services, we process your payments through a Third-Party application. The Third-Party application may collect certain financial information from you to process a payment on behalf of Anna Campbell, including your name, email address, address and other billing information.

    Human Resources Data

    Anna Campbell collects Personal Information from current, prospective, and former Employees, their contact points in case of a medical emergency, and beneficiaries under any insurance policy (“Human Resources Data”). The Human Resources Data we collect may include title, name, address, phone number, email address, date of birth, passport number, driver’s license number, government-issued identification number, financial information related to credit checks, bank details for payroll, information that may be recorded on a CV or application form, language abilities, contact information of third parties in case of an emergency and beneficiaries under any insurance policy.  

    We acquire, hold, use and Process Human Resources Data for a variety of business purposes including:

    o   Workflow management, including assigning, managing and administering projects;

    o   Human Resources administration and communication;

    o   Payroll and the provision of benefits;

    o   Compensation, compensation analysis, including monitoring overtime and compliance with labor laws, and company recognition programs;

    o   Job grading activities;

    o   Performance and employee development management;

    o   Organizational development and succession planning;

    o   Benefits and personnel administration;

    o   Absence management;

    o   Helpdesk and IT support services;

    o   Regulatory compliance;

    o   Internal and/or external or governmental compliance investigations;

    o   Emergency contacts and services;

    o   Employee safety;

    o   Compliance with statutory requirements;

    o   Processing of Employee expenses and travel charges; and

    o   Acquisitions, divestitures, and integrations.

     

    Onward Transfer—Anna Campbell May Disclose Your Information

    Information We Share

    We may share your information as described in this Privacy Policy (e.g., with our Third-Party service providers; to comply with legal obligations; to protect and defend our rights and property) or with your permission.

    o   Information Shared with Our Services Providers. We may engage third-party services providers to work with us to administer and provide the Services. Some of examples of these third-party’s services include payment processing, shipping, and handling returns. These third-party services providers have access to your Personal Information only for the purpose of performing services on our behalf and are expressly obligated not to disclose or use your Personal Information for any other purpose. When you make a payment, the third-party payment processor (e.g., Stripe or PayPal) receives your full payment information and we receive only a funding confirmation.

    o   Business Partners. Anna Campbell may share Personal Information with our business partners, and affiliates for our and our affiliates’ internal business purposes or to provide you with a product or service that you have requested. Anna Campbell may also provide Personal Information to business partners with whom we may jointly offer products or services, or whose products or services we believe may be of interest to you. In such cases, our business partner’s name will appear, along with Anna Campbell.

    o   Marketing – Interest-Based Advertising and Third-Party Marketing. Through our Services, Anna Campbell may allow Third-Party advertising partners to set tracking tools (e.g., cookies) to collect information regarding your activities (e.g., your IP address, page(s) visited, time of day). We may also share such de-identified information as well as selected Personal Information (such as demographic information and past purchase history) we have collected with Third-Party advertising partners. These advertising partners may use this information (and similar information collected from other websites) for purposes of delivering targeted advertisements to you when you visit non-Anna Campbell related websites within their networks. This practice is commonly referred to as “interest-based advertising” or “online behavioural advertising. We may allow access to other data collected by the Site to facilitate transmittal of information that may be useful, relevant, valuable or otherwise of interest to you.     The Site includes the Anna Campbell page located at www.annacampbell.com.au, which extracts content from our users and customers who share photos and videos on Instagram using Anna Campbell’s brand hashtags, including #AnnaCampbell, #AnnaCampbellBridal, #ACBride, or tagging the Anna Campbell’s Instagram account @annacampbellbridal (all such hashtagged or @- labelled photos and videos, “Tagged Media”). You acknowledge and agree that the Tagged Media may be used in Anna Campbell’s retail locations, showrooms, email, on our Site or other websites that we operate or control, and you hereby grant us permission to use and authorize others to use your name or social media handle in association with the Tagged Media for identification, publicity related to the Services and similar promotional purposes, including after you terminate your use of the Services. You represent and warrant that posting and use of your Tagged Media, including to the extent such Tagged Media include your name, likeness, voice, or photograph, does not violate, misappropriate or infringe on the rights of any third party, including, without limitation, privacy rights, publicity rights, copyrights, trademark or other intellectual property rights.

If any provision of these Terms is held invalid or unenforceable (either by an arbitrator appointed pursuant to the terms of the “Dispute Resolution” section above or by court of competent jurisdiction), that provision will be enforced to the maximum extent permissible and the other provisions of these Terms will remain in full force and effect. You may not assign or transfer these Terms, by operation of law or otherwise, without Anna Campbell’s prior written consent. Any attempt by you to assign or transfer these Terms, without such consent, will be null. Anna Campbell may freely assign or transfer these Terms without restriction. Subject to the foregoing, these Terms will bind and inure to the benefit of the parties, their successors and permitted assigns.

    Notices

    Any notices or other communications provided by Anna Campbell under these Terms, including those regarding modifications to these Terms, will be given: (i) via email; or (ii) by posting to the Services. For notices made by e-mail, the date of receipt will be deemed the date on which such notice is transmitted.

    Waiver of Rights

    Anna Campbell’s failure to enforce any right or provision of these Terms will not be considered a waiver of such right or provision. The waiver of any such right or provision will be effective only if in writing and signed by a duly authorized representative of Anna Campbell. Except as expressly set forth in these Terms, the exercise by either party of any of its remedies under these Terms will be without prejudice to its other remedies under these Terms or otherwise.
